Naga Chaitanya, a celebrated star in Indian cinema and a scion of a legendary film family—as the son of actor Nagarjuna and grandson of iconic star A. Nageswara Rao—filed a commercial suit seeking judicial intervention against the unauthorized use of his likeness.
The court’s directive arrives in response to the growing menace of AI-driven impersonations and online harassment. Justice Jyoti Singh has ordered the immediate removal of all infringing and unauthorized content within 24 hours of the directive being issued.
The scope of the injunction is comprehensive, targeting:
- Pornographic Content: Unidentified websites and platforms are strictly prohibited from using the actor’s name, image, or voice for pornographic material.
- AI-Generated Deepfakes: The defendants are barred from utilizing generative AI, face-morphing, and deepfake technologies to portray the actor in inappropriate or defamatory scenarios.
- Unauthorized Merchandise: The court has officially halted the production and sale of merchandise, such as T-shirts, bearing the actor’s likeness, citing an infringement upon his commercial and endorsement rights.
The Delhi High Court has specifically identified the digital platforms that must facilitate these removals. Google LLC has been explicitly directed to purge offending links from its video-sharing platform, YouTube. Additionally, several identified pornographic websites have been ordered to take down specific URLs that were found to be exploiting the actor’s persona.
The injunction also extends to “John Doe” defendants—unidentified online sellers and anonymous platforms—ensuring that the protection covers a broad spectrum of potential digital infringements.
In its assessment, the court emphasized that a celebrity’s identity is not public property. Justice Jyoti Singh observed that the unapproved exploitation of a celebrity’s identity causes irreparable damage to their hard-earned goodwill, privacy, and dignity.
